A regular meeting of the City Council of the City of Boston was held in the Christopher A. Iannella Chamber, City Hall at
12:05 on Wednesday, December 1, 2010
Councilors Present: President Ross in the Chair. All Councilors Present.
Clergy:Reverend Liz Steinhauser, St. Stevens, delivered the invocation and the meeting was opened with the pledge of allegiance to the flag.

1592 President Ross moved to adopt the minutes from the November 17, 2010 meeting. Motion prevailed. Message and order approving a Petition for a Special Law re: “An Act to Facilitate the Mediation of Mortgage Foreclosures of Owner Occupied Residential Real Property in the City of Boston.” Referred to the Committee on Government Operations.
1593 Message and order approving a Petition for a Special Law re: “An Act Relative to the Establishment of the City of Boston Group Insurance Commission.” Referred to the Committee on Government Operations.
1594 Message and order approving the issuance of tax exempt bonds in the principal amount not to exceed $55,000,000.00 from the Boston Industrial Development Financing Authority (BIDFA), for the project to be located at 800 Huntington Ave. Referred to the Committee on Economic Development and Planning.
1595 Message and order authorizing the City to increase the amount of the 41C Elderly Property Tax Exemption that pursuant to Massachusetts General Laws Chapter 59, Section 5 Clause 41C, the City of Boston elects to increase the minimum exemption amount from $500.00 to $750.00. Referred to the Committee on Government Operations. Councilor Ross moved reconsideration of Docket No. 1595. Reconsideration prevailed. On motion of Councilor Ross the order was referred to the Committee on Ways and Means.
1596 Message and order authorizing the Fire Department to accept and expend a grant of $57,441.19 from the Massachusetts Department of Transportation, for the purpose of reimbursing the Fire Department for personnel, material, and equipment cost relating to the relocation of fire alarm box facilities on Dorchester Avenue. On motion of Councilor Murphy, the rules were suspended; the order was passed.
1597 Message and order authorizing the Police Commissioner to accept and expend a FY2011 Traffic Enforcement Grant funds of $30,000.00 from the Massachusetts Executive Office of Public Safety and Security’s Highway Safety Division. On motion of Councilor Murphy, the rules were suspended; the order was passed.
1598 Message and order authorizing the Fire Department to accept two (2) pre-owned Life Fitness Recumbent Lifecycles from the Frontline Fitness Equipment, for the purpose of promoting the health and wellbeing of firefighters. On motion of Councilor Murphy, the rules were suspended; the order was passed.
1599 The Constable Bond of William Dicarlo, having been duly approved by the Collector-Treasurer, was received and approved under the usual terms and conditions.
1600 Notice was received from the Mayor of his absence from the City on November 16, 2010 until November 22, 2010. Placed on file.
1601 Notice was received from the City Clerk in accordance with Chapter 6 of the Ordinances of 1979 re: action taken by the Mayor on paper acted upon by the City Council at its meeting on October 27, 2010. Placed on file.
1602 Notice was received from the City Clerk in accordance with Chapter 6 of the Ordinances of 1979 re: action taken by the Mayor on paper acted upon by the City Council at its meeting on November 3, 2010. Placed on file.
1603 Communication was received from the Mayor re: Waiver for Personnel Services Allotment ��" Voter Mobilization. Placed on file.
1604 Communication was received from Councilors Ross and LaMattina, transmitting a multiple City Analysis and Report of site visit to Los Angeles regarding food trucks. Placed on file.
1605 Communication was received from the City Clerk of the filing by the Boston Redevelopment Authority of the “Application of Walnut Avenue Apartments Limited Partnership 461 walnut Avenue Chapter 121A”. Placed on file.
1606 Communication was received from the City Clerk of the filing by the Boston Redevelopment Authority of the “Application of Old Colony Phase Two a Limited Partnership Chapter 121A”. Placed on file.
1607 Communication was received from Michael Ross, President of the Boston City Council, that the City Council will meet December 1, 2010 at 3:00 p.m. to discuss City Council rule 40A. Placed on file.
1510 Councilor LaMattina, on behalf of the Committee on City, Neighborhood Services and Veteran Affairs, submitted the following: On the message and order, referred on November 3, 2010, Docket #1510, authorizing the Commissioner of the Parks and Recreation Department to accept and expend a capital grant of $500,000.00 from the Commonwealth of Massachusetts, Executive Office of Environmental Affairs, for Communities (PARC) Program for renovations to the Howes Playground located in the Roxbury neighborhood of Boston, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1511 On the message and order, referred on November 3, 2010, Docket #1511, authorizing the Commissioner of the Parks and Recreation Department to accept and expend a capital grant of $500,000.00 from the Commonwealth of Massachusetts, Executive Office of Environmental Affairs, for Communities (PARC) Program for renovations to the Cronin/Wainwright Park located in the Dorchester neighborhood of Boston, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1512 On the message and order, referred on November 3, 2010, Docket #1512, authorizing the Commissioner of the Parks and Recreation Department to accept and expend a capital grant of $329,382.00 from the Commonwealth of Massachusetts, Executive Office of Environmental Affairs, for Communities (PARC) Program for renovations to the Laviscount Park located in the Roxbury neighborhood of Boston, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1513 On the message and order, referred on November 3, 2010, Docket #1513, authorizing the Commissioner of the Parks and Recreation Department to accept and expend a capital grant of $310,648.00 from the Commonwealth of Massachusetts, Executive Office of Environmental Affairs, for Communities (PARC) Program for renovations to the Alvah Kittredge Park located in the Roxbury neighborhood of Boston, the Committee submitted a report recommending the order ought to pass. The report was accepted; the order was passed.
1547 On the message and order, referred on November 17, 2010, Docket #1547, authorizing the City to permanently dedicate Laviscount Park for park purposes in accordance with M.G.L. Chapter 45, Section 14 and to have the administration take such other actions as needed to so dedicate this park for park purposes in accordance with the terms and conditions of a $329,382.00 grant awarded by the Division of Conservation Services in the Mass. Executive Office of Energy and Environmental Affairs, the Committee submitted a report recommending the order ought to pass. 1613 Order requesting certain information under Section 17F: re: a list of homicides in Boston since 1994 by name, age, gender, location, arrests and convictions. On motion of Councilor Yancey, the rules were suspended; the order was passed.
1614 Councilor Ross offered the following: Order that pursuant to Chapter 40, section 56, the residential factor in the City of Boston for FY2011 shall be the minimum residential factor as determined by the Commissioner of Revenue pursuant to M. G. L., Chapter 58, section 1A, and be it further that pursuant to Chapter 403 of the acts of 2000, a residential exemption in the amount of value equal to thirty percent (30%) of the average assessed value of all Class One-Residential parcels in the City of Boston be, and hereby is approved for Fiscal Year 2011. Referred to the Committee on Ways and Means.
